1. Introduction

These Terms of Service (“Terms”) apply to all marketing and creative services provided by SHOW Digital Media, a business unit of Global Digital Services Pty Ltd (“SHOW”, “we”, “us”, or “our”).

By engaging with our services, visiting our website, or accessing any delivered work or platform, you agree to these Terms and our Privacy Policy.

2. Services

SHOW offers a full range of marketing, advertising, and creative services. These include (but are not limited to):

•Marketing campaign strategy and delivery

•Creative production (video, graphics, animations, copywriting)

•Social media posting and automation

•Paid ad creation (Google, Meta, TikTok, programmatic)

•Geofencing and mobile retargeting campaigns

•Digital signage campaign planning and execution (via SIMI)

•AI-powered tools and chat agents for content and campaign creation

•Industry-specific marketing bundles

•White-labeled tools and reseller solutions

•Reporting dashboards and campaign performance summaries

SHOW may expand or change its offerings at any time.

3. Client Responsibilities

Clients agree to:

•Provide complete and accurate information to support project delivery

•Review and approve content within set deadlines

•Ensure submitted materials do not infringe on third-party rights or violate advertising standards

•Pay invoices in full and on time

4. Fees & Payment Terms

•All work is billed as per the agreed scope, quotation, or retainer

•Additional services or revisions outside the agreed scope may incur further charges

•Late payment may result in delayed work or service suspension

•Full ownership of deliverables is transferred to the client upon final payment (unless otherwise stated)

5. AI Tools and Automation

You acknowledge that some services may be powered or assisted by AI technologies. All AI-generated materials are subject to manual review, and the final responsibility lies with the client before public use.

6. Refunds & Cancelations

•Work already completed is non-refundable

•Cancelations must be submitted in writing with at least 7 days’ notice

•SHOW reserves the right to retain partial payment for time or resources already allocated

7. Intellectual Property

SHOW retains ownership of all creative materials until full payment is received. After payment, clients receive a non-exclusive license to use the final deliverables for approved purposes.

We reserve the right to showcase work in our portfolio unless explicitly requested otherwise in writing.

8. Limitation of Liability

SHOW will not be liable for indirect damages, loss of business, or campaign underperformance. All services are provided “as-is” based on available data and tools.

9. Governing Law

These Terms are governed by the laws of Victoria, Australia. Legal disputes will be handled by the courts of Victoria.
